GENERAL RELEASE AGREEMENT AND WAIVER OF LIABILITY

RELEASE AND WAIVER OF LIABILITY:

I, the undersigned (hereinafter referred to as “Participant”), in consideration for
being permitted to participate in the La Jolla Summer White Party XXV! on June 15,
2024 and June 16, 2024 (hereinafter referred to as “Charitable Event”), which shall
take place at 7855 Calle Juela, La Jolla, Ca, 92037, 7869 Calle Juela, La Jolla, Ca
92037, And 2139 Torrey Pines Road, La Jolla, Ca 92037 (hereinafter referred to as
the “Premises”), on behalf of myself, my heirs, assigns, executors, guardians, legal
representatives, personal representatives, and successors, DO HEREBY, FULLY
AND FOREVER, RELEASE, WAIVE, DISCHARGE, HOLD HARMLESS
AND COVENANT NOT TO SUE:
The La Jolla Summer White Party LLC
the owners of the Premises, specifically Daniel F. Courtney
and The Jack Richardson Racing Stables Trust, as amended,
or any of its or their respective members, officers, affiliates, directors,
employees, attorneys, agents, contractors, volunteers, entertainers or other
Charitable Event personnel (collectively, the “Released Parties”) from any and all
liability, claims, demands, damages, causes of action, losses, or expenses (including
attorneys’ fees), that may arise from participation at the Charitable Event, including
without limitation, personal injury, illness, death, whether caused by active or passive
negligence of all or any of the Released Parties, any other participant, person, thing or
otherwise.

I further expressly agree that the foregoing release and waiver is intended to be as
broad and inclusive as is permitted by the law of the State of California and that if any
portion thereof is held invalid, it is expressly agreed that the balance shall,
notwithstanding, continue in full force and effect.

ASSUMPTION OF RISK :

I further acknowledge and agree that participation in Charitable Event is voluntary
and that doing so carries with it certain inherent risks that cannot be eliminated
regardless of the care taken to avoid injuries. Specific risks vary from one activity to
another. Inherent risks may include, but are not limited to: (1) minor injuries such as
scratches, bruises, and sprains; (2) major injuries such as eye injury and loss of sight,
joint or back injuries, heart attacks, and concussions; and (3) catastrophic injuries,
including paralysis and death. Risks assumed include venturing out on remote
areas of the premise not included as part of the grounds, the parking lot and the
surrounding streets adjacent to the the “Premises The risks outlined in this document
are not exhaustive, and I acknowledge that there may be other risks, hazards, and
dangers that, based on the circumstances, are integral to my voluntarily attending
the Charitable Event and nevertheless I, on behalf of myself, my heirs, assigns,
executors, guardians, legal representatives, personal representatives, and
successors, assume such risks and responsibility for any loss suffered from the
same or otherwise.

INDEMNITY :
I, on behalf of myself, my heirs, assigns, executors, guardians, legal
representatives, personal representatives, and successors, agree to
INDEMNIFY,

REFUNDS:
No refunds will be issued under any circumstance;

PHOTO RELEASE:

I understand that I am procuring a ticket to attend an event at the “Premises” and that
photos and videos will be taken at the event. I grant The La Jolla White Party LLC
and its officers, employs agents, assigns, and volunteers the irrevocable and
unrestricted right and permission to take reuse, publish and republish photographic
portraits, videos or pictures of me and I waiver any right to remuneration or
compensation.

ACKNOWLEDGE:
I am a twenty-one (21) years of age or older. Driver’s license or government ID are
required before being allowed to enter The Grounds of La Jolla (“Premises”.) I agree
to drink responsibly. The La Jolla White Party staff will stop serving alcohol to
participants who are visibly intoxicated. It is suggested that participants in the event
use Uber, Lyft or have a designated driver.  If unable to drive, please reach out to a
volunteer or a host who will assist you in getting transportation.

I, as the Participant, acknowledge that I have read the above Release and Waiver
of Liability, Assumption of Risk, and Indemnity Agreement and fully understand
the terms contained herein and understand that I am giving up substantial
rights, including the right to sue. I acknowledge that I am signing this agreement
freely and voluntarily and, by my signature, agree unconditionally to the release
of all liability to the greatest extent permitted by law.
