I acknowledge and agree to the following:

RELEASE AND WAIVER OF LIABILITY
ASSUMPTION OF RISK
INDEMNITY AGREEMENT

The undersigned (hereinafter referred to as “Participant”, In CONSIDERATION for being permitted to
participate in the 25th Annual La Jolla Summer White Party XXV, June 15th and June 16th, 2024
(hereinafter referred to as “Charitable Event”) taking place at the Grounds of La Jolla
 (hereinafter referred to as the “Premises”), PARTICIPANT, my heirs, assigns, executors, guardians,
legal representatives, personal representatives, and successors do hereby, fully and forever, release,
waive, discharge and covenants not to sue the La Jolla Summer White Party, the owners of the sites at
which the Charitable Event is taking place (Daniel F. Courtney / The Jack Richardson Racing Stables
Trust), or any of their respective affiliates, Directors, employees, agents, contractors, volunteers, or other
Charitable Event personnel, whether volunteers or paid staff (collectively, the “Releasees”) from any and
all liability resulting from personal injury, accidents or illnesses (including death), claims, demands,
damages, causes of action, losses, or expenses (including attorney’s fees and expenses) that may arise
from participation at the Charitable Event, whether caused by the active or passive negligence of all or
any of the Releasees or otherwise. Participant further expressly agrees that the foregoing release and
waiver is intended to be as broad and inclusive as is permitted by the law of the State of California and
that if any portion thereof is held invalid, it is expressly agreed that the balance shall, notwithstanding,
continue in full legal force and effect.

ASSUMPTION OF RISK
Participation in Charitable Event carries with it certain inherent risks that cannot be eliminated regardless
of the care taken to avoid injuries. The specific risks vary from one activity to another. Inherent risks
include, but are not limited to: (1) minor injuries such as scratches, bruises, and sprains; (2) major
injuries such as eye injury and loss of sight, joint or back injuries, heart attacks, and concussions; and (3)
catastrophic injuries, including paralysis and death. The risks outlined in this document are not
exhaustive and Participant acknowledges that there may be other risks, hazards, and dangers that, based
on the circumstances, are integral to my attending the Charitable Event.

INDEMNITY
Participant agrees to NDEMNIFY, SAVE AND HOLD HARMLESS the Releasees and each of them from
any loss, liability, damage, or cost they may incur arising out of or related to the use of the Premises for
the Charitable Event whether caused by negligence or gross negligence of the Releasees or otherwise.

Furthermore, this indemnification is binding on my heirs, assigns, executors, guardians, legal
representatives, personal representatives, and successors.

Participant, furthermore, acknowledges being twenty-one (21) years or older.
Participant, furthermore, acknowledges that there are NO REFUNDS under any circumstances.

I, as the Participant, acknowledge that I have read the above Release and Waiver of Liability, Assumption
of Risk, and Indemnity Agreement and fully understand the terms and understand that I am giving up
substantial rights, including the right to sue. I acknowledge that I agree freely
and voluntarily and agree unconditionally to the release of all liability to the greatest
extent permitted by law.
